FoodMi (hereinafter referred to as “FoodMi” or the “Provider”) operates the website foodmi.app (hereinafter the “Website”) and the FoodMi application, a digital calorie and nutrition tracking tool (hereinafter the “App” or the “Product”) for Android and iOS.

This privacy policy informs you about the types of personal data of FoodMi users that are processed, the purposes for which they are processed and the extent of the processing. This privacy policy applies to all processing of personal data by FoodMi, both in the context of providing services and, in particular, on the Website and in the FoodMi App that users can install on their mobile device, as well as within external online presences such as FoodMi's social media profiles (hereinafter collectively referred to as the “Online Offering”).

The controller within the meaning of the General Data Protection Regulation (GDPR), i.e. the entity responsible for the collection, processing and use of personal data of users, is:

2. Encryption

All incoming and outgoing data, both in communication with the applications and in communication with third-party providers, is transmitted in encrypted form. The encrypted connection when using the FoodMi website is visible, for example, in the address bar of the browser used, which starts with “https://”. Thanks to encryption, transmitted data cannot be read by third parties.

3. Collection, Processing and Use of Personal Data

3.1. Personal Data

Within the meaning of the GDPR, “personal data” means any information relating to an identified or identifiable natural person. Personal data (e.g. email address, nutritional data in the App) will only be processed by the Provider in accordance with applicable data protection law.

3.2. Data Collection When Using the FoodMi Website

When you visit the website foodmi.app, the web server, based on FoodMi's legitimate interests under Article 6(1)(f) of the GDPR, automatically records log files that cannot be attributed to a specific person, if this is necessary for the operation of the application. This data includes, for example, browser type and version, operating system, referring URL, IP address, date and time of access, and the file requested by the client. This data is collected solely for statistical analysis and security purposes and is retained for seven days, then deleted.

3.2.1. Use of Cookies

In order to make the website more user-friendly and efficient, FoodMi or third parties engaged by FoodMi may store cookies on the user's hard drive, provided the user has given consent in accordance with Article 6(1)(a) of the GDPR. A cookie is a small text file that is used, among other things, to record information about the use of a website. These cookies cannot execute programs or transmit viruses to the user's computer. The storage of cookies can be disabled or limited in the browser settings, or the browser can be configured to warn the user when a cookie is sent.

3.3. Personal Data When Using the FoodMi App

3.3.1. Information Required When Creating a Personalized User Account

To use the App, the user must provide the required information: “email address” and “password”. These serve to identify the user and enable communication between the Provider and the user. Data is stored based on each user's consent under Article 6(1)(a) of the GDPR.

3.3.2. Use with “Sign in with Apple” / “Sign in with Google”

The user has the option to create a FoodMi account via their Apple or Google account. When signing in with Apple ID, the personal email address can be hidden or shared with FoodMi. When using Google sign-in, FoodMi collects and stores personal data such as the user's email address and possibly first name, last name, and profile photo.

3.3.3. Data Provided by the User

In addition to the required information (email address and password), the user may optionally provide their first name, last name and place of residence. Furthermore, FoodMi records data provided by the user which may be entered during use of the App. This includes a user profile, which includes but is not limited to the following body and health data:

  • Age/date of birth
  • Gender
  • Height
  • Diet (e.g. vegan)
  • Goal (e.g. lose weight)
  • Activity level
  • Recorded activities
  • Calorie consumption and activity calories
  • Step count
  • Starting weight, weight history and target weight
  • Water consumption
  • Favorite recipes

Data is collected based on user consent under Article 6(1)(a) of the GDPR. Providing body data is necessary to use the App's features, particularly starting weight/target weight, gender, date of birth and height, so that FoodMi can calculate the user's personal calorie goal.

3.3.4. Data Automatically Recorded by FoodMi

When the App is installed, the following are recorded once: installation date, registration date, operating system, country and language. During use, FoodMi also records: current IP address, App version used, and current time zone. This data is recorded in order to improve and personalize services, based on FoodMi's legitimate interest under Article 6(1)(f) of the GDPR.

3.3.5. Payment Processing

When a contractual relationship is established, FoodMi retains user personal data under Article 6(1)(b) of the GDPR as necessary for contract performance. In-app purchases are processed through the relevant distribution platform (Apple App Store, Google Play Store). Payment data is collected directly by the app stores. Premium features may also be purchased via the FoodMi website, using payment processors such as Stripe. User data is shared only for payment processing purposes.

3.4. AI-Generated Wellness and Health Reports

FoodMi offers an optional feature that provides AI-generated wellness and nutrition reports (“AI Health Reports”). These reports are created from information voluntarily provided by the user.

4. Data Exchange with Third Parties

FoodMi takes the protection of users' personal data very seriously. FoodMi treats personal data confidentially and in accordance with legal data protection provisions and this privacy policy. FoodMi collects and stores data provided by third-party providers only on the basis of the user's consent under Article 6(1)(a) of the GDPR.

4.1. Apple Health

Users have the option to link their app to Apple Health. Data such as total activity, workouts, weight, blood pressure, BMI, and nutritional energy may be exchanged between FoodMi and Apple Health.

4.2. Google Health Connect

FoodMi offers users the option to link the app to Google Health Connect. Categories of data that may be accessed or shared include: activity data, body measurements, heart and vital signs, nutritional data, and general health data. Users retain full control of their data and can modify permissions or unlink Health Connect at any time via FoodMi's app settings.

5. Contact and Customer Support

FoodMi uses a customer service platform to process user requests. Personal data provided by users in the context of their contact request is used only to respond to the request and is not transmitted to third parties. The user has the right to withdraw consent to data retention at any time with future effect.

6. Use by Children

FoodMi is not intended for children under 16 without parental consent. If FoodMi learns that personal data of a child below the minimum age has been collected without parental consent, FoodMi will take the necessary steps to delete such data without delay.

7. Use of Web Analytics Tools

Based on user consent under Article 6(1)(a) of the GDPR, FoodMi may use various tools and plug-ins for web analytics purposes. Cookies may be used to transmit the IP address and/or record and analyze different types of data, such as the number of website visitors, duration of visits, and origin of visitors. These cookies are used to provide more targeted offerings to FoodMi users.

8. Deletion of User Data

FoodMi retains users' personal data for the duration of their use of the App. If the user account is deleted, the email address, first name, last name, profile photo and links to third-party providers will be permanently and irreversibly deleted.

9. User Rights

The user has the following rights under the GDPR:

  • Right of access (Article 15 GDPR) — obtain information about personal data held by FoodMi
  • Right to rectification (Article 16 GDPR) — correct inaccurate or incomplete personal data
  • Right to withdraw consent (Article 7(3) GDPR) — withdraw consent at any time with future effect
  • Right to erasure (Article 17 GDPR) — request deletion of personal data
  • Right to restriction of processing (Article 18 GDPR) — request restriction of processing
  • Right to data portability (Article 20 GDPR) — receive personal data in a structured, commonly used and machine-readable format
  • Right to object (Article 21 GDPR) — object to processing based on legitimate interests
  • Right to lodge a complaint (Article 77 GDPR) — lodge a complaint with the competent supervisory authority

This privacy policy is currently in effect as of February 2026. If our website or product is improved, or if legal requirements change, it may be necessary to amend this privacy policy. The current version can always be viewed at https://foodmi.app/privacy.
